Purchase of your property

If you have already found your ideal property, we recommend that you should instruct Winterbrook Conveyancing as soon as possible. This will minimise any potential for delays. We will provide the Estate Agents and your Mortgage Broker with all the details they’ll need to perform their roles in the transaction. We will also liase with the Sellers Solicitor to start proceedings.

Sale of your property

If you have a related property sale, we recommend that you appoint Winterbrook Conveyancing as soon as possible, and preferably before a sale is agreed. Whilst the property is being marketed, our Conveyancing team can be preparing all the paperwork in readiness. This simple decision can often reduce the time taken to finalise a transaction by two to three weeks!

Getting Started

We will provide you with a formal instruction form and other documents which will enable us to gather all of the required details of you and your house. Once you confirm your instructions to us we will contact the other parties and request relevant contracts and documentation.

Searches on your purchase

Once we have received the contract documentation from the Sellers Solicitor we will be able to arrange the necessary searches of the Local Authority, Water Authority and Environment Agency should you require them.

Mortgage details

Once your mortgage offer has been issued, your Solicitors will explain the terms and conditions of it. The Contract documentation and Mortgage Deed will be sent to you for approval and signature. You then simply return them

Exchange of contracts

At this stage, a date will be agreed for formal completion of the transaction, and once contracts have been ‘exchanged’, both parties will be legally committed to the transaction. Your Solicitor will also complete any final searches required by your lender and prepare the completion statement requesting any additional money from you (if applicable). The completion statement will also account for any fees payable to your Solicitor and estate agents.

Completion of your move

The day of completion is the day on which you formally take ownership of your new home. On this day, your Solicitor will:

  • Finalise all the legal paperwork for you
  • Discharge your existing mortgage and draw down funds for your new mortgage (if applicable).
  • Settle your Stamp Duty with HM Revenue & Customs, along with any fees based on the completion statement.
  • Arrange for the legal transfer to be signed and arrange for your ownership to be registered with HM Land Registry.
  • Liase with the other side’s Solicitor and the Estate Agents to avoid delays with the handing over of keys to your new home.
